Unfair dismissal

Since 1 July 2009, new unfair dismissal rules govern employers and their actions when terminating the employment of a staff member.

The laws have increased the number of workers who may make an unfair dismissal claim, and the process for lodging a claim has been simplified.

Getting a termination wrong could be expensive and highly disruptive to your business — get it right and your chances of defending a claim will be significantly enhanced.

NSW Business Chamber has put together two comprehensive resources to help businesses minimise the risk of an unfair dismissal claim — from the recruitment of an employee, performance management and dismissal of an underperforming employee.
